Terms of Service (ToS)

In case of conflicts between language versions, the German version prevails.

1. Scope

These Terms of Service (ToS) apply to the use of the website mietkuendigung.ch and all related services, operated by Joel Waeber (hereinafter the «Operator»).

By using the website and/or purchasing a service, you agree to these ToS.

2. Service Description

mietkuendigung.ch provides automated information processing regarding Swiss tenancy law. The tool calculates deadlines, validates inputs, and generates documents based on the user's entries and applicable Swiss law.

Important: mietkuendigung.ch is not a legal advice service. It is an automated information tool. The generated documents and information do not replace individual legal advice from a lawyer or the tenant association (Mieterverband).

3. Limitation of Liability

To the extent permitted by law (Swiss Code of Obligations Art. 100), the Operator accepts no liability for:

  • The factual accuracy, completeness, or timeliness of the generated documents and calculations
  • Missed deadlines or dates based on use of the tool
  • Incorrect calculations of termination notice periods or termination dates
  • Rejected or contested terminations of any kind
  • Financial damages of any kind arising directly or indirectly from use of the tool
  • Outages, data losses, or technical issues of the platform

Use of mietkuendigung.ch is at the user's own risk.

Insofar as liability is not already excluded under the above points, damages for slight negligence are in any case limited to the price actually paid by the customer (maximum CHF 19.90 per order). Liability for intentional or grossly negligent conduct as well as personal injury remains unaffected under Swiss CO Art. 100.

4. No Legal Advice

This tool does not replace individual legal advice. All information, calculations, and generated documents are based on automated processing of publicly available legal sources (Swiss Code of Obligations, Civil Code, Federal Supreme Court decisions, cantonal regulations).

The Operator is not a lawyer and does not provide legal services. Use of the tool does not establish a client-lawyer relationship.

5. Prices and Payment

mietkuendigung.ch offers free and paid services:

  • Deadline Calculator: Free
  • Letter (Basic): CHF 9.90 (one-time payment)
  • Premium: CHF 19.90 (one-time payment)

Payments are one-time. There is no subscription and no recurring costs.

Payment processing is handled by Stripe Payments Europe Limited (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland) as payment processor. The legal seller and your contractual counterparty is the Operator (see Section 1). For questions regarding payments and invoices, please contact info@mietkuendigung.ch.

6. No Right of Withdrawal

Swiss law does not provide a statutory right of withdrawal for online purchases initiated by the consumer (Swiss CO Art. 40a–f does not apply).

By purchasing, you agree that the service will be provided immediately. A refund is excluded unless the service is not provided due to a technical error.

Customers residing in the EU: Under EU Directive 2011/83/EU Art. 16(m), the 14-day right of withdrawal for digital content expires as soon as the service is performed with your express consent and you simultaneously acknowledge the loss of the right of withdrawal. You give this consent upon confirming the payment.

7. Intellectual Property

The termination letters and documents generated by the tool belong to the user. The user may freely use, copy, and forward them.

The tool itself (code, design, texts, calculation logic) is the intellectual property of the Operator and protected by copyright. Any reproduction, distribution, or use without written consent is prohibited.

8. Availability

The Operator strives to provide uninterrupted availability of the tool. However, there is no entitlement to continuous availability. Maintenance work, technical failures, or force majeure may cause temporary outages.

9. Amendments to the ToS

The Operator reserves the right to amend these ToS at any time. The current version is always available on this page. Completed purchases are subject to the ToS valid at the time of purchase.

10. Applicable Law and Jurisdiction

Swiss law applies exclusively.

Place of jurisdiction is the domicile of the Operator in Switzerland, insofar as legally permissible. Mandatory statutory jurisdictions (in particular Swiss ZPO Art. 32 for consumers) remain reserved.
